HAVOSPARK® Warranty Policy

 

1. Scope of This Warranty

This Warranty Policy applies to HAVOSPARK® products purchased directly from HAVOSPARK® or from an authorized HAVOSPARK® reseller, retailer, distributor, or commercial partner.

HAVOSPARK® warrants that eligible products will be free from defects in materials and workmanship under normal and intended use during the applicable warranty period.

This warranty is provided in addition to any mandatory statutory rights, consumer guarantees, or remedies that cannot be excluded under applicable local law.

2. Products Covered

This warranty may apply to HAVOSPARK® products including:

  • Electric Surfboards
  • Underwater Scooters and Diving Propulsion Products
  • Electric Mini Jet Boats
  • Electronic Components
  • Motors and Thruster Systems
  • Batteries and Battery Packs
  • Chargers and Power Components
  • Other HAVOSPARK® products specifically identified as covered by warranty

Warranty periods and coverage may vary by product, model, battery configuration, component, and sales agreement.

Free promotional accessories, consumable items, and certain wear parts may not be covered unless otherwise stated.

3. Standard Warranty Period

Unless otherwise stated on the product page, quotation, Proforma Invoice, sales contract, or specific product warranty document, the standard product warranty period is:

12 months from the date the customer receives the product.

Certain batteries, components, or product categories may have a different warranty period if expressly stated in writing at the time of purchase.

For example, where a specific battery warranty of 24 months is expressly stated in the product documentation or sales agreement, that specific battery warranty period will apply.

The warranty period is not restarted or extended by a repair, replacement part, or ownership transfer unless required by applicable law or expressly confirmed by HAVOSPARK® in writing.

4. What Is Covered

During the applicable warranty period, HAVOSPARK® may provide warranty support for verified defects caused by:

  • defective materials;
  • manufacturing defects;
  • faulty workmanship;
  • eligible electronic component failures;
  • eligible motor or propulsion system failures;
  • other confirmed manufacturing-related defects.

Each warranty claim will be evaluated based on the product condition, usage history, available evidence, and applicable warranty terms.

5. What Is Not Covered

This limited warranty does not generally cover damage or failure caused by:

  1. improper, unsafe, or unintended use;
  2. accidents, collision, impact, dropping, or physical damage;
  3. striking rocks, debris, underwater objects, docks, vessels, or other foreign objects;
  4. foreign objects entering or damaging a thruster, jet pump, impeller, motor, or propulsion system;
  5. misuse, abuse, neglect, or failure to follow operating instructions;
  6. unauthorized disassembly, modification, repair, alteration, or tampering;
  7. use of non-approved parts, chargers, batteries, accessories, or electrical components;
  8. improper charging, battery storage, battery handling, or battery maintenance;
  9. water intrusion caused by improper assembly, damage, modification, or failure to follow sealing procedures;
  10. normal wear and tear;
  11. cosmetic damage that does not materially affect product function;
  12. scratches, surface marks, fading, paint loss, or normal appearance changes caused by use;
  13. damage caused by improper transportation, storage, handling, or packaging after delivery;
  14. damage caused by operation outside the stated environmental or performance limits;
  15. commercial misuse or operation beyond the intended duty cycle where applicable.

Carbon-fiber, polymer, composite, ASA, PE, aluminum, or other hull and housing damage caused by impact, collision, improper handling, abuse, or external force is not considered a manufacturing defect unless HAVOSPARK® determines otherwise.

6. Battery Warranty

Battery warranty coverage applies only to eligible manufacturing defects and does not cover normal degradation caused by age, use, charging cycles, storage conditions, temperature, or ordinary capacity loss.

Battery warranty does not generally cover:

  • normal reduction in battery capacity over time;
  • improper charging;
  • use of an unauthorized charger;
  • deep discharge caused by improper storage;
  • water damage caused by misuse;
  • physical damage;
  • damaged connectors caused by misuse;
  • unauthorized opening or repair of the battery pack;
  • damage caused by transportation that does not comply with battery shipping requirements.

Lithium batteries are regulated goods and may require special transportation, packaging, and handling procedures when returned for inspection or replacement.

Customers must not ship a battery without receiving return instructions from HAVOSPARK®.

7. Warranty Remedies

If HAVOSPARK® determines that a warranty claim is valid, HAVOSPARK® may, at its discretion and subject to applicable law:

  1. provide a replacement component or part;
  2. repair the defective product;
  3. replace the defective product with the same or an equivalent product;
  4. reimburse an approved reasonable repair cost;
  5. provide another appropriate remedy.

The specific remedy will depend on the nature of the defect, availability of replacement parts, product location, shipping restrictions, and applicable legal requirements.

Nothing in this policy excludes a refund or other remedy where such remedy is required by applicable consumer law.

8. Shipping Costs for Warranty Claims

Shipping arrangements for warranty claims depend on the cause of the issue and the destination.

For confirmed manufacturing defects, HAVOSPARK® may arrange or reimburse reasonable shipping costs where appropriate.

If a product is submitted as a warranty claim and HAVOSPARK® determines after inspection that the issue is not covered by warranty, the customer may be responsible for:

  • shipping the product to the inspection or service location;
  • return shipping;
  • diagnostic or service charges;
  • repair costs;
  • replacement parts.

HAVOSPARK® will notify the customer of any non-warranty charges before carrying out paid repair work.

9. Purchases Through Authorized Resellers or Distributors

If the product was purchased from an authorized HAVOSPARK® reseller, retailer, or distributor, the customer may be required to contact that seller first.

Unless otherwise stated in the applicable reseller or distributor agreement, replacement parts or warranty products may be shipped to the authorized seller, who may then coordinate delivery to the end customer.

Warranty procedures may vary depending on the country, reseller agreement, shipping arrangement, and local consumer law.

10. Transfer of Warranty

Warranty coverage may be transferable to a subsequent owner if HAVOSPARK® approves the transfer and the original proof of purchase is available.

A warranty transfer does not restart or extend the original warranty period.

11. How to Make a Warranty Claim

Please provide as much of the following information as possible:

  1. proof of purchase or delivery receipt;
  2. invoice number or order number;
  3. purchaser’s name;
  4. current owner’s name, if different;
  5. delivery address;
  6. email address and phone number;
  7. product model;
  8. product serial number, where available;
  9. clear description of the issue;
  10. date the issue was first noticed;
  11. photographs showing the product and affected area;
  12. video showing the reported malfunction, where applicable;
  13. any error codes or system messages;
  14. any other information reasonably requested by HAVOSPARK®.

Photos and/or videos may be required to evaluate the claim before the product is returned.

12. Inspection and Evaluation

HAVOSPARK® may first attempt to diagnose the issue remotely using photos, videos, technical information, operating history, or guided troubleshooting.

If physical inspection is required, HAVOSPARK® will provide return or service instructions.

Do not return a product, battery, or component without prior authorization.

13. Warranty Service and Repairs

If repair work is required, HAVOSPARK® may:

  • provide replacement parts;
  • provide technical repair instructions;
  • arrange repair through an authorized service provider;
  • request that the product be returned to an authorized service location;
  • or approve a local repair solution.

Unauthorized repairs performed before HAVOSPARK® has evaluated the warranty claim may affect warranty eligibility.

14. Local Consumer Rights

Nothing in this Warranty Policy excludes, restricts, or reduces any statutory rights or consumer guarantees that cannot legally be excluded in the customer’s country or region.

Where local laws provide greater consumer protection than this limited warranty, the applicable mandatory legal requirements will apply.

This commercial warranty is additional to any applicable statutory consumer rights.

15. Product Specifications and Updates

HAVOSPARK® reserves the right to update product specifications, technical documentation, manuals, components, accessories, software, operating instructions, and product design from time to time.

Product improvements or specification changes do not automatically create an obligation to modify products purchased previously unless required by applicable law.

16. Commercial, Distributor and Project Orders

Commercial orders, distributor orders, government orders, project orders, customized products, training equipment, or other negotiated B2B transactions may be subject to separate warranty terms stated in the applicable quotation, Proforma Invoice, contract, distributor agreement, or other written agreement.

Where a specific written commercial agreement applies, those terms will prevail for that transaction to the extent permitted by applicable law.
