Welcome to https://havospark.net (the “Site”), operated under the HAVOSPARK® brand.

These Terms of Service govern your access to and use of the Site, including any purchases, inquiries, services, content, features, tools, products, and related communications made available through the Site.

By accessing or using the Site, you agree to be bound by these Terms of Service and any policies referenced herein. These Terms supersede prior or contemporaneous communications relating to your use of the Site, except where a separate written agreement has been signed between HAVOSPARK and the customer.

ACCEPTANCE

By using the Site, you represent that you are at least 18 years old, or the age of majority in your jurisdiction, and that you have the legal capacity to enter into these Terms of Service.

If you do not agree with these Terms, you must not use the Site.

PRODUCTS AND SERVICES

HAVOSPARK offers electric water sports products, rescue equipment, training programs, related accessories, spare parts, and other products or services that may be made available from time to time.

Product specifications, images, descriptions, availability, configurations, colors, accessories, certifications, packaging, and performance information may be updated without prior notice.

Actual product performance may vary depending on operating conditions, rider weight, battery condition, environment, configuration, maintenance, and other factors.

PRICING

Unless otherwise stated, prices displayed on the Site are in U.S. dollars.

Prices are subject to change without notice. Taxes, duties, customs charges, shipping costs, insurance, import fees, local delivery charges, and other transaction-related costs may or may not be included depending on the applicable quotation, shipping term, destination, and order arrangement.

For commercial, distributor, government, project, or customized orders, the terms stated in the applicable quotation, Proforma Invoice, sales contract, or written agreement will prevail.

PAYMENT TERMS — ORDERS

We may accept payment by credit card, PayPal, bank transfer, or other approved payment methods.

Unless otherwise agreed in writing, orders will not be released for shipment until the required payment has been received.

For customized products, commercial orders, production orders, project orders, distributor orders, or training programs, payment terms may be specified separately in the applicable quotation, Proforma Invoice, contract, or written agreement.

We reserve the right to cancel, suspend, or delay an order if payment cannot be verified or processed.

ORDER ACCEPTANCE

Submission of an order does not necessarily constitute final acceptance by HAVOSPARK.

We reserve the right to refuse or cancel an order due to product unavailability, pricing errors, suspected fraud, payment issues, regulatory restrictions, destination limitations, shipping restrictions, compliance requirements, or other reasonable commercial considerations.

If a paid order is cancelled by HAVOSPARK before fulfillment, any applicable refund will be handled according to the payment method and relevant policy.

LIMITED QUANTITIES AND PRODUCT AVAILABILITY

We reserve the right to limit the quantity of any product or service offered.

We may discontinue, modify, replace, or update products, configurations, accessories, specifications, or services at any time without prior notice.

Availability may vary by country, market, destination, certification requirement, or production schedule.

SHIPPING AND DELIVERY

Shipping methods, delivery estimates, shipping terms, customs arrangements, import duties, taxes, local delivery, and insurance vary depending on the destination and order.

Any stated delivery date or transit time is an estimate unless expressly guaranteed in writing.

International shipments may be subject to customs clearance, import procedures, inspections, carrier delays, port congestion, weather, regulatory requirements, or other circumstances outside our reasonable control.

RETURNS AND REFUNDS

Returns and refunds are subject to our current Return and Refund Policy.

Unless otherwise stated in the applicable policy or sales agreement, eligible returns must comply with the stated return period, product condition requirements, authorization procedures, shipping arrangements, and other applicable conditions.

Customized products, used products, activated products, special-order items, commercial project orders, certain batteries, and other restricted products may be subject to additional return limitations.

WARRANTY

Warranty coverage varies by product, model, component, and order configuration.

Applicable warranty terms, exclusions, claim procedures, and coverage periods are governed by our current Warranty Policy and any written warranty terms provided with the product or order.

Warranty coverage generally does not apply to damage caused by misuse, abuse, unauthorized modification, accident, improper storage, improper charging, improper maintenance, normal wear and tear, operation outside specified conditions, or failure to follow applicable instructions.

BATTERIES AND SAFETY

Certain HAVOSPARK products contain lithium batteries or other electrical components.

Customers are responsible for following applicable charging, storage, transport, maintenance, operating, safety, and disposal instructions.

Battery transport, shipping, import, airline carriage, and local use may be subject to regulatory restrictions.

Customers are responsible for confirming destination-specific requirements before transporting or operating battery-powered products.

PRODUCT USE AND LOCAL REGULATIONS

Customers are responsible for ensuring that products are operated lawfully and safely in the intended location.

Registration, licensing, operator qualifications, insurance, waterway permissions, commercial rental requirements, safety rules, import requirements, product classification, and other regulatory obligations may vary by country or region.

HAVOSPARK does not guarantee that a particular product may be operated without registration, licensing, certification, authorization, or other local requirements in every jurisdiction.

COMMERCIAL, DISTRIBUTOR AND EXCLUSIVE DISTRIBUTION INQUIRIES

Submission of a distributor, dealer, reseller, or exclusive distribution inquiry does not create any distribution rights, exclusivity, pricing entitlement, territory protection, or agency relationship.

Prospective distributors may be required to purchase and evaluate initial sample units, conduct local product testing, demonstrate market activity, and provide a business plan or expected order volume before dealer pricing, authorized distributor status, or territorial exclusivity is considered.

Any distributor appointment, exclusivity arrangement, pricing structure, sales target, territory, term, or other commercial right must be confirmed in a separate written agreement signed by HAVOSPARK.

TRAINING PROGRAMS

Rescue training programs, technical exchanges, instructor development, customized courses, and related services may be subject to separate quotations, schedules, participation requirements, safety rules, cancellation terms, and written agreements.

Course content, instructors, training locations, duration, practical exercises, equipment, certification, assessments, and other arrangements may vary according to the specific program.

INTELLECTUAL PROPERTY

All content on the Site, including the HAVOSPARK® name, trademarks, logos, product names, images, videos, text, graphics, technical materials, design elements, and other content, is owned by or licensed to HAVOSPARK or its affiliated entities unless otherwise stated.

No content may be copied, reproduced, distributed, modified, republished, commercially exploited, or used in a misleading manner without prior written authorization.

PROHIBITED USE

You may not use the Site or its content:

  • for unlawful or fraudulent purposes;
  • to infringe intellectual property rights;
  • to misrepresent affiliation with HAVOSPARK;
  • to impersonate HAVOSPARK or an authorized distributor;
  • to interfere with Site security or functionality;
  • to distribute malicious code;
  • to scrape, copy, or republish Site content for unauthorized commercial purposes;

If there is a conflict between these Terms of Service and a signed contract, Proforma Invoice, quotation, distributor agreement, training agreement, or other written commercial agreement, the specific written agreement will prevail with respect to that transaction.
